QureMarvel provides AI-powered healthcare technology solutions, including clinical decision support (QureAssist), medical imaging AI (QureVision), patient data consolidation (QureView), patient risk prediction (QurePredict), and system integration services (QureConnect). Our website also offers educational programs, research publications, and informational content related to healthcare AI.

3. Eligibility

You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

4. User Accounts

Certain features of our Services may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials, all activities that occur under your account, and notifying us immediately of any unauthorised access or use. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You agree not to use our Services to violate any applicable laws, regulations, or industry standards; infringe upon the intellectual property rights of others; transmit malicious software, spam, or harmful content; attempt to gain unauthorised access to our systems or other users' accounts; misrepresent your identity or affiliation; use our AI products in ways that could endanger patient safety; or reverse engineer, decompile, or disassemble any of our software or algorithms.

6. Intellectual Property

All content, software, algorithms, models, designs, text, graphics, logos, trademarks, and other materials available through our Services are the property of QureMarvel or its licensors and are protected by intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any of our intellectual property without prior written consent. The names QureMarvel, QureAssist, QureVision, QureView, QurePredict, and QureConnect are trademarks of QureMarvel. Unauthorised use is prohibited.

7. Healthcare Disclaimer

QureMarvel's products are designed to assist healthcare professionals in clinical decision-making. They are not a substitute for professional medical judgment, diagnosis, or treatment. Our AI tools provide recommendations and insights based on data analysis, but all clinical decisions must be made by qualified healthcare professionals. QureMarvel does not provide direct medical care to patients. We are not responsible for clinical outcomes resulting from the use or misuse of our products. Our products are intended for use by trained healthcare professionals within appropriately licensed healthcare institutions.

8. Product and Service Terms

Use of QureMarvel's products (QureAssist, QureVision, QureView, QurePredict, QureConnect) by healthcare institutions is governed by separate Enterprise Licence Agreements, Business Associate Agreements, and Data Processing Agreements executed between QureMarvel and the client institution. In the event of any conflict between these Terms and a signed Enterprise Agreement, the Enterprise Agreement shall prevail.

9. Educational Programs

Enrolment in QureMarvel's training programs is subject to availability and payment of applicable fees. Program fees are non-refundable unless otherwise stated at the time of enrolment. QureMarvel reserves the right to modify program content, schedules, and pricing. Completion of a training program does not constitute professional certification or licensure. Certificates of completion are issued by QureMarvel and are not accredited by any regulatory body unless explicitly stated.

10. Payment Terms

For paid Services, you agree to provide accurate and complete payment information, pay all fees as described at the time of purchase, and accept that all fees are in Indian Rupees (INR) unless otherwise stated. QureMarvel reserves the right to change pricing with reasonable notice. Refund policies are specified at the point of purchase for each service.

11. Privacy

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection and use of information as described in our Privacy Policy.

12. Limitation of Liability

To the maximum extent permitted by law, QureMarvel and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use our Services, any errors, inaccuracies, or omissions in our products or content, any unauthorised access to or alteration of your data, or any third-party conduct or content on our Services. Our total liability for any claims arising from these Terms or your use of our Services shall not exceed the amount you paid to QureMarvel in the twelve months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless QureMarvel and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our Services, your violation of these Terms, your violation of any third-party rights, or any content you submit or transmit through our Services.

QureMarvel reserves the right to modify, suspend, or discontinue any part of our Services at any time, with or without notice. We may also update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our Services after any modifications constitutes acceptance of the updated Terms.

15. Termination

We may terminate or suspend your access to our Services at any time, with or without cause, and with or without notice. Upon termination, your right to use our Services ceases immediately. Provisions of these Terms that by their nature should survive termination shall remain in effect.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any applicable Enterprise Agreements, constitute the entire agreement between you and QureMarvel regarding your use of our Services and supersede all prior agreements and understandings.
